When you use the AI-powered services provided by Arran Scott ("AI Products"), you warrant that you will comply with this document, our Legal Terms and all applicable laws and regulations governing AI. Your usage of our AI Products signifies your agreement to engage with our platform in a lawful, ethical, and responsible manner that respects the rights and dignity of all individuals. If you do not agree with these Legal Terms, please refrain from using our Services.

This Policy applies to any and all:

• (a) uses of our Services (as defined in our Legal Terms);
• (b) forms, materials, consent tools, comments, posts, and all other content available on the Services ("Content");

• Use any automated scraping of vehicle data, or bots to manipulate search rankings or listing visibility.
• List vehicles that you do not have physical control or possession of (e.g. cars still at auction, "coming soon" vehicles, or vehicles in transit).
• Sell, transfer, or share profiles, which compromises platform security and accountability.
• Manipulate, falsify, or hide vehicle information such as mileage, accident history, or ownership status.

Subscriptions

If you subscribe to our Services, you understand and agree that you may not, except if expressly permitted:

• Engage in any use, modification, copying, redistribution, publication, display, performance, or retransmission of any portions of the Services without prior written consent.
• Reconstruct or attempt to discover any source code or algorithms of the Services.
• Intercept any data not intended for you.
• Damage, reveal, or alter any other user's data, hardware, software, or information.
• Facilitate off-platform transactions, perform automated scraping, post fraudulent listings, or use bots to manipulate visibility.

AI Products

When you use the AI Products provided by Arran Scott, you warrant that you will not:

• Deploy AI techniques that are subliminal, manipulative, or deceptive and that distort behaviour or impair informed decision-making, particularly where such actions cause significant harm.
• Exploit vulnerabilities related to age, disability, or socio-economic circumstances through AI in a way that distorts behaviour or decision-making.
• Use AI systems for biometric categorisation that infer sensitive attributes such as race, political opinions, trade union membership, religious or philosophical beliefs, sex life, or sexual orientation, except in narrowly permitted cases.
• Implement AI-based social scoring systems that classify individuals or groups in a manner that causes harm, discrimination, or unfair treatment.
• Assess the risk of an individual committing criminal offences based solely on profiling or personality traits.
• Compile facial recognition databases through untargeted scraping of facial images from the internet, social media, or CCTV footage.
• Use AI to infer emotions in sensitive environments such as workplaces or educational institutions.
• Engage in real-time remote biometric identification in public places for law enforcement purposes, except where there are strong legal justifications and oversight.

Community / Forum Guidelines

• Respectful Conduct: Treat others with respect. Harassment, hate speech, bullying, or discriminatory language will result in an immediate and permanent ban.
• Authentic Listings: All vehicle listings must be accurate, honest, and represent the actual vehicle being sold.
• No Commercial Spam: The platform is for private buyers and sellers. Do not promote unrelated goods, services, or external commercial links.
• Privacy & Safety: Do not share personal information (private addresses, financial details, personal phone numbers) in public areas. Communicate through the platform's tools.
• No Malicious Activity: Hacking, scraping, spamming, or disrupting the website is prohibited and will be reported.
• Platform Role: Shift Auto Market is an information service. All disputes regarding sales must be handled directly between the buyer and the seller.

Artificial Intelligence

We recognise the significant impact AI can have on our users and society, and we are committed to ensuring that our AI Products are designed and operated in a way that aligns with fairness, transparency, and accountability. This Policy applies to all AI-powered features in our Services and governs the development, deployment, and use of AI technologies.

Enforcement

• Temporary Suspension: Temporary suspension of access to AI Products or platform features while the issue is investigated.
• Termination of Access: Permanent termination of access for serious violations.
• Legal Action: Where misuse leads to significant harm, data breaches, or legal violations.
• Public Disclosure: For incidents impacting public trust or involving severe ethical breaches.

Commitment to Responsible AI

We are committed to repairing any harm caused by misuse of AI, correcting biased outcomes, and implementing additional safeguards. We regularly review and update this Policy to reflect technological advancements and legal changes in local, national, and international regulations.

Contributions

In this Policy, "Contribution" means:

• any data, information, software, text, code, music, scripts, sound, graphics, photos, videos, tags, messages, interactive features, or other materials you post, share, upload, submit, or otherwise provide on or through the Services; or
• any other content, materials, or data you provide to Arran Scott or use with the Services.

We may, but are under no obligation to, review or moderate Contributions and expressly exclude liability for any loss or damage resulting from a user's breach of this Policy.

You warrant that:

• you are the creator and owner of, or have the necessary licences, rights, consents, and permissions to use, your Contributions;
• all your Contributions comply with applicable laws and are original and true;
• your Contributions do not infringe the proprietary rights of any third party;
• you have permission of every identifiable individual person depicted in your Contributions.

You also agree that you will not post any Contribution that:

• breaches applicable laws, regulation, court order, contractual obligation, this Policy, our Legal Terms, or promotes or facilitates fraud or illegal activities;
• is defamatory, obscene, offensive, hateful, insulting, intimidating, bullying, abusive, or threatening to any person or group;
• is false, inaccurate, or misleading;
• includes child sexual abuse material or violates any applicable law concerning child protection;
• solicits personal information from anyone under the age of 18 or exploits people under the age of 18;
• promotes violence, advocates the violent overthrow of any government, or incites physical harm against another;
• is sexually explicit, lewd, lascivious, violent, harassing, libellous, or otherwise objectionable;
• is discriminatory based on race, sex, religion, nationality, disability, sexual orientation, or age;
• bullies, intimidates, humiliates, or insults any person;
• promotes or facilitates acts of terrorism;
• infringes any third party's intellectual property or privacy rights;
• misrepresents your identity or your affiliation with any person or with us;
• contains unsolicited advertising, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.

You may not use our Services to offer, promote, or sell:

• items that promote or facilitate illegal activity;
• cigarettes;
• controlled substances, narcotics, steroids, drug paraphernalia, or other products that present a risk to consumer safety;
• knives or other weapons regulated under applicable law;
• firearms, ammunition, or certain firearm parts or accessories;
• certain sexually oriented materials or services;
• items the seller does not yet control or possess;
• any items, goods, or services that are not road-legal vehicles, automotive parts, or automotive-related accessories. We also prohibit listing insurance write-offs (Category A and B), vehicles with undisclosed outstanding finance, and any fraudulent or "ghost" listings where the seller does not possess the vehicle;
• stolen goods;
• products or services identified by government agencies as highly likely to be fraudulent;
• any transaction requiring pre-approval that has not been obtained.

Reviews and Ratings

When your Contribution is a review or rating, you agree that:

• you have firsthand experience with the vehicle listing or seller being reviewed;
• your Contribution is true to your experience;
• you are not affiliated with competitors if posting negative reviews (or linked to a seller if posting positive reviews);
• you cannot make or offer conclusions as to the legality of conduct;
• you cannot post any false or misleading statements;
• you will not organise a campaign encouraging others to post reviews, whether positive or negative.

Reporting a Breach of This Policy

Consequences of Breaching This Policy

Complaints and Removal of Legitimate Content

If you believe Content or a Contribution has been mistakenly removed, please contact us and we will promptly review the decision. The Content may stay down during the review process.

Moderation & Content Removal Process

• Automated Monitoring: Our platform uses automated filters to detect prohibited items, offensive language, or indicators of fraudulent activity.
• User Reporting: Every listing and profile has a "Report" function for the community to flag violations.
• Human Review: A member of our team manually reviews flagged content against our guidelines.
• Compliance Check: If content is compliant, no action is taken.
• Warning / Correction: For minor errors we may contact the user to request an update.
• Removal: Content that is illegal, fraudulent, or clearly violates our guidelines will be removed immediately.
• Account Restriction: Repeat offenders or severe violations will result in a permanent ban.
• Transparency: Users whose content is removed will be notified of the reason and may appeal.

Disclaimer

Arran Scott is under no obligation to monitor users' activities and disclaims responsibility for any user's misuse of the Services. We have no responsibility for any Content or Contribution created, maintained, stored, transmitted, or accessible on or through the Services. If we become aware that Content or a Contribution violates this Policy, we may, in addition to removing it and blocking your account, report the breach to the police or appropriate regulatory authority.
